Wisconsin Latest State to Outlaw Revenge Porn

Wisconsin has become the latest state to pass an anti-revenge porn law. Following Utah and Idaho earlier this year, the state joins New Jersey, California, and Alaska in the push back against the practice of distributing explicit or nude photos of a person against their consent, or, as it’s otherwise known, exceptionally obvious commonsense and decency.

What about the first amendment you might be tempted to whine on Reddit right now, to which I have a succinct legal rebuttal: you’re a fucking loser pervert.

The text of the law, which you can read here, explains more (emphasis added):

Whoever, without the consent of the person represented,  reproduces, distributes, exhibits, publishes, transmits, or otherwise disseminates a  representation of a nude or partially nude person or of a person engaging in sexually  explicit conduct is guilty of a Class A misdemeanor. The consent of the person  represented to the capture of the representation or to the possession of the representation by the actor is not a defense to a violation of this subsection.

In other words, as should have already been obvious, the fact that someone agreed to let you take their picture naked, or sent you a picture of themselves naked, is not consent to show that photo to the entire world on the internet.

This comes as Representative Jackie Speier of California is in the process of introducing a federal revenge porn law for consideration.

But wait, you might be thinking, why do we need a law for this? If you don’t want your nude photo on the internet, just don’t take one, right? As I’ve written on this subject before, “that’s like arguing that the only way to protect against pregnancy and STDs is by preaching abstinence-only sex-ed. It’s simply not going to work.” Also, congratulations, you’re a victim-blaming piece of shit. It’s the equivalent of saying “Well, she shouldn’t have dressed, or undressed rather, that way if she didn’t want to get raped.”
